
Lucknow: Abdullah Azam Khan, son of senior Samajwadi Party leader Azam Khan, has been given a big relief by the Supreme Court. The Supreme Court has placed an interim stay on the by-election to the Swar assembly seat. It is noteworthy that the Allahabad High Court had ordered by-elections in the Swar Assembly. However, now the Supreme Court has stayed the by-election on Swar by placing an interim stay on the order of the High Court.

The argument of the Election Commission’s counsel did not work
Explain that on December 16, 2019, it was the High Court that canceled the candidature of Abdullah Azam, the SP MLA of Swar and son of Azam Khan. Subsequently, on February 27, the Assembly Secretariat had announced that the seat was vacant. The High Court did not accept the plea of the Election Commission’s counsel and directed to hold elections on the Swar seat as soon as possible.
However, this decision was challenged by Abdullah in the Supreme Court. Abdullah had said in his petition that it was not appropriate to hold a by-election in his seat till the Supreme Court gives its final verdict on it. On which the court has now pronounced its verdict.
This is the whole case
It is noteworthy that on December 16, 2019, the High Court had canceled the election of Abdullah Azam. In fact, Aakash Saxena, the BJP leader from Rampur, had filed a case against Mohammad Azam Khan’s son for making two birth certificates each and contesting elections on the basis of fake birth certificates. It was challenged in the High Court on behalf of Azam Khan. Hearing the same petition, the court had canceled the election of Abdullah Azam, after which the Swar assembly seat of Rampur was declared vacant.
