New Delhi: A Delhi court rejected the appeal of a man challenging the order of granting interim alimony to a separated wife, stating that it is a social and legal obligation of the husband to pay alimony to a wife brought in by lawful marriage Cannot run away from responsibilities. However, the court said that since the wife is educated, she should also find a job for herself and should not let her talent be ruined by sitting empty in the house.
Principal District and Sessions Judge Swarn Kant Sharma said that the order of the magistrate court is correct that the husband should provide Rs. 20,000 per month as interim maintenance allowance to his wife. The court said in an order passed on March 25, “As per the established law, the appellant (husband) cannot run away from his responsibility to pay alimony to the wife brought by lawful marriage. It is his social and legal obligation to the wife. “
During the hearing, the person’s lawyer had claimed that his wife left his mother-in-law for no reason and refused to return. The lawyer said that the person has been unemployed since 2019 as he left his job to study. Therefore, the lower court passed the interim order without considering its current status and responsibilities.
Advocate for the wife, Amit Kumar, argued that he was allegedly being tortured at the in-laws house, due to which he lodged a complaint against her under the Domestic Violence Act and started living with his brother.
