New Delhi: A petition filed to restrain Justice DY Chandrachud from taking oath as the next CJI i.e. Chief Justice was heard in the Supreme Court. The Supreme Court on Wednesday dismissed a plea seeking to restrain senior-most Justice DY Chandrachud from taking oath as the Chief Justice on November 9.
In fact, while rejecting this petition, the Supreme Court said that after hearing the argument of the lawyer, we did not see any reason to consider the petition. The Supreme Court further said that the petition is completely misleading. A bench headed by Chief Justice Uday Umesh Lalit heard the matter today i.e. Wednesday at 1:45 pm. The nominated Chief Justice of India Chandrachud is to take oath as the 50th Chief Justice of India on November 9.
Who is Justice Chandrachud?
Let us inform you that in the past, Union Law Minister Kiren Rijiju had announced the appointment of Justice Chandrachud as Chief Justice and his tenure as CJI would be for two years. Justice Chandrachud is the son of the longest-serving CJI in the country, Justice YV Chandrachud. His father was the head of the Indian judiciary from 22 February 1978 to 11 July 1985. Justice Chandrachud was elevated as a judge of the apex court on 13 May 2016 and will retire on 10 November 2024.
CJI to replace UU Lalit
Justice Chandrachud will succeed Justice Uday Umesh Lalit, who retires on attaining the age of 65 years. Justice Lalit is retiring from the post of CJI on November 8 and had a brief tenure of 74 days in the post. Justice Chandrachud, who sees dissent as the ‘safety valve of democracy’, has been a part of several Constitution Benches and Supreme Court benches that have delivered landmark judgments.
