There is a similar question if due to some human error someone gets killed in an accident or someone gets seriously injured, can an insurance claim be made in such cases also?

A claim cannot be rejected
An official of another insurer said, “If an unfortunate event occurs due to negligence, the insurance company is legally mandated to honor the damage claim to the vehicle.” He said that the claim cannot be dismissed on the basis of whether the rear passengers were wearing seat belts or not.
