New Delhi: The Aam Aadmi Party (AAP) has announced its intention to challenge the recent decision by the Delhi High Court to stay the bail granted to Chief Minister Arvind Kejriwal. The case revolves around allegations of money laundering related to the now-defunct Delhi Excise policy.

Background

The trial court had initially granted bail to Kejriwal on June 20, allowing his release on a personal bond of Rs 1 lakh. However, the Enforcement Directorate (ED) swiftly moved the high court, arguing that the trial court’s order was “perverse,” “one-sided,” and based on irrelevant facts.

High Court’s Ruling

In a significant development, the Delhi High Court upheld the ED’s contentions and stayed the trial court’s bail order. Justice Sudhir Kumar Jain, presiding over the vacation bench, criticized the trial court for failing to adequately assess the evidence presented by the ED. He emphasized that the lower court should have given the agency a fair opportunity to argue its case.

AAP’s Response

Reacting to the High Court’s decision, the AAP expressed strong disagreement. A party spokesperson stated, “We firmly disagree with the Delhi High Court’s order. We are prepared to challenge it in the Supreme Court.” The party believes that Kejriwal’s bail should not have been stayed and intends to pursue the matter further.

Excise Policy Scam

The case centers around alleged irregularities and corruption related to the Delhi Excise policy of 2021-22. The policy was subsequently scrapped in 2022 after the Lieutenant Governor ordered a CBI probe. Both the CBI and the ED contend that undue favors were extended to license holders during the policy’s formulation and execution.
