JEE, NEET 2020: SC dismisses exam, review petition only on 13 September

New Delhi: The Supreme Court on Friday rejected a review petition filed by six cabinet ministers from six states seeking permission for the JEE, NEET exam to be held in September against the order of August 17. The petition, filed through advocate Sunil Fernandes, stated that the court order “fails to secure the safety and right to life of the students/candidates appearing for the JEE, NEET examination”.

The Supreme Court on Friday dismissed the six-state reconsideration petition filed for cancellation of JEE-NEET. Now NEET-UG exam will be held from 13th September itself. JEE Main has started from 1 September.

The petition was filed before Justices Ashok Bhushan, Bhushan Gavai and Krishna Murari at 1.30 pm today. A private hearing was held in the “Chamber”. Only judges were present. No lawyer was allowed to appear or argue. Earlier on August 17, the writ petitions were dismissed by a division bench of Justices Arun Mishra, BR Gavai and Krishna Murari. As Justice Arun Mishra retired on Wednesday, the matter will be heard by a bench headed by Justice Ashok Bhushan.

The petitioners noted that the apex court “ignored the initial logistic difficulties in conducting the examination at the proposed dates” and “failed to balance important aspects like examination and safety of the students”. The review petition was filed by West Bengal Minister Molloy Ghatak, Jharkhand Minister Rameshwar Oraon, Rajasthan Minister Raghu Sharma, Chhattisgarh Minister Amarjeet Bhagat, Punjab Minister BS Sidhu and Maharashtra Minister Uday Ravindra Rant.

The review petition also stated that the August 17 order is “esoteric, non-lingual” and will not discuss the various aspects and complexities involved in matters of this magnitude.
