New Delhi: The Supreme Court has set aside an order of the Karnataka High Court quashing criminal proceedings against a government official for abetment to suicide, observing that the mental health of a person should be considered as “one mold for all”. The approach cannot be narrowed down. A bench of Justices DY Chandrachud and BV Nagarathna termed the High Court’s observation that the ‘suicide note’ did not contain any material to substantiate the allegations.

The bench said, “The Single Judge, in the exercise of power under section 482 of CrPC, apart from deciding on the merits of the case, has also made observations diluting the importance of mental health. The mental health of an individual cannot be reduced to a vision of ‘one mold fit for all.”

The top court said that the single judge of the High Court has termed the person who decided to commit suicide as a “person of weak heart” and also noted that the behavior of the deceased before committing suicide was not like that of a depressed and suffering from mental health. Was.
