Patna: The Bihar Assembly on Wednesday passed the Bihar Prohibition and Excise (Amendment) Bill, 2022. In this bill, a provision of punishment has been given for the drinker. The bill empowers the state government to prescribe certain punishments for offenses. Earlier this power was with the court. It is noteworthy that, in view of the increasing pressure in court and in jail, the state government was preparing to amend this law from the end of 2021. which has been passed today.
Otherwise one month in jail
In the new law, a lot of leeway have been given to those who drink alcohol. If a person is caught drinking or drinking for the first time, he will be released by the Magistrate with a fine. At the same time, if he fails to pay the fine, he will be jailed for one month. Whereas if caught repeatedly drinking alcohol, strict action will be taken.
Under the new liquor law, the trial in cases based on it will have to be completed within one year. At the same time, if a large quantity of illegal liquor is caught, the police will have the right to destroy the remaining liquor by keeping a sample liquor. To do this, the police will no longer need permission from the collector.
Door is in the hands of the state government
Significantly, in the Bihar Liquor Prohibition Law Amendment Bill, 2022, the state government will issue directions for seizure, search, and destruction of liquor. All offenses punishable under the new law, except those under section 35, shall be tried by a special court. At the same time, the persons arrested in these cases who are still in jail will be released. But he shall be released only after he has completed the term of imprisonment mentioned in section 37.
