Prayagraj: Providing that two adults can live together in a live-in relationship, the Allahabad High Court has directed the Senior Superintendent of Police, Farrukhabad to provide security to a couple who are living together in a live-in relationship. The order was passed by Justice Anjani Kumar Mishra and Justice Prakash Padia on Monday while hearing a writ petition filed by Kamini Devi and Ajay Kumar of Farrukhabad.
The petitioners argued before the court that they are both adults and love each other. They have been living together like a couple for the last six months, but Kamini’s parents are harassing them. The petitioners allege that Kamini’s parents wanted her to marry a middle-aged man. The petitioners had lodged a complaint in this regard with the Senior Superintendent of Police, Farrukhabad on March 17, 2020, but their application is pending till date.
The bench, after hearing the arguments of the parties concerned, said, “The Hon’ble Supreme Court in its landmark judgment has made provision that where a boy and a girl are adults and are living together of their own free will, then anyone including their parents They also have no right to interfere in living together. ”
Accepting the petition, the bench said, “We are of the view that these petitioners have the freedom to live together and no one will be allowed to interfere in their peaceful life. The right to life is a fundamental right under Article 21 of the Constitution of India, which provides that no person shall be deprived of the right to life and personal liberty. ”
