Most divorces are happening in love marriages only: Supreme Court judge’s comment

New Delhi: On Wednesday, the Supreme Court, while hearing the matter of a matrimonial dispute between a couple, made a big comment regarding love marriage and divorce. Here Justice BR Gavai said that most cases of divorce are coming in love marriage.

According to the Bar and Bench report, a two-member bench of Justice BR Gavai and Justice Sanjay Karol was hearing a transfer petition related to a matrimonial dispute. During this, the lawyer of one side of the case informed the court that the couple had a love marriage. Responding to this, Justice Gavai said, ‘Most divorces are happening in love marriage only.’

According to the report, the court again proposed mediation in the matter, but the woman’s husband opposed it. On this, the court said that in view of a recent decision, she can divorce even without his consent. After this, the Supreme Court bench once again advised the couple to go for mediation.

Let us tell you that the Supreme Court had recently said in one of the decisions that in the event of the continuation of the marriage being impossible, it can order divorce on its behalf under Article 142. For this, there is no need to go to the family court and wait for the prescribed period of 6 months for divorce.
