New Delhi: The Anjuman Intezamia Masjid Committee moved the Supreme Court on Thursday challenging the Allahabad High Court order allowing the Archaeological Survey of India (ASI) to conduct a scientific survey of the Gyanvapi mosque complex. Referring to the matter in the Supreme Court, the counsel for the Masjid Committee said that the ASI should not be allowed to conduct the survey. The Supreme Court says it will look into the issue.
Advocate Nizam Pasha asked Chief Justice D.Y. to mention the matter to Chandrachud. The Chief Justice is heading a five-judge constitution bench hearing arguments on the Article 370 issue. Pasha said, “The Allahabad High Court has passed an order today. We have filed SLP (Special Leave Petition) against the order. I have sent an email (requesting an urgent hearing). They should not proceed with the survey proceedings.
The Chief Justice said, “I will see the email immediately.” A party from the Hindu side has also filed a caveat in the Supreme Court stating that no order should be passed in this matter without hearing them.
Significantly, today the Allahabad High Court rejected the petition of the Anjuman Intejamia Masjid Committee against the survey of the Gyanvapi Masjid complex. The order of the Varanasi district court was issued on July 21 and was challenged by the Anjuman Intejamia Masjid Committee. The Anjuman Intezamia Masjid Committee looks after many mosques including Gyanvapi. Chief Justice Pritinkar Diwakar reserved his decision on July 27 after hearing all the parties.
