New Delhi: The report of the Joint Parliamentary Committee (JPC) on the Data Protection Bill was presented in the Rajya Sabha on Thursday. This has paved the way for the first data protection law in India. India is one of the largest internet economies worldwide and is also promoting global tech talent. In view of ‘data is the new oil’, there needs to be a clear law on this.

The report submitted by the committee will be debated soon. If passed, this law gives priority to the protection of both personal and non-personal data. More importantly, there will be an authority for data protection.

  1. Promote concepts like Consent Framework, Purpose Limitation, Storage Limitation and Data Minimization
  2. The Data Fiduciary may collect only that data which is necessary for a specific purpose with the express consent of the individual (Data Principal).
  3. To provide the person with the right to receive personal data, correct incorrect data, erase data, update data, port the data to other fiduciaries and restrict or prevent the disclosure of personal data
  4. To establish an authority to be called the Data Protection Authority of India, which shall consist of a Chairperson and not more than six whole-time members to be appointed by the Central Government.
  5. The authority shall protect the interests of data principals, prevent any misuse of personal data, ensure compliance with the provisions of the proposed law and promote awareness of data protection.
  6. To specify a provision relating to social media intermediary whose action has a significant impact on electoral democracy, the security of the State, public order or the sovereignty and integrity of India.
  7. The Data Principal aggrieved by the decision of the Data Fiduciary may approach the Authority for making a complaint.
  8. To empower the central government to exempt any agency of the government from the operation of the proposed law.
  9. Promote good data protection practices and empower authorities to comply with this law.
  10. To appoint Adjudicating Officers for the purpose of deciding the punishment and compensation to be imposed under the provisions of this Act.
  11. Establishment of Appellate Tribunal to hear and dispose of any appeal
  12. Provision for imposition of fine and penalty for contravention of the provisions of the proposed law
