
New Delhi: In a significant legal victory for Elon Musk, the Supreme Court of Brazil has granted permission for the restoration of social media platform X (formerly Twitter) in the country. Justice Alexandre de Moraes ruled on Tuesday to lift the ban on the platform, which had been inactive for over a month in Brazil, a nation with a population of 213 million people. The platform, with an estimated 20 to 40 million users in Brazil, had been shut down following Musk’s refusal to comply with the Brazilian court’s orders.
The August Ban: Allegations of Hate Speech and Legal Non-Compliance
The shutdown of X occurred on August 30, 2024, following a Supreme Court judge’s order. The court had demanded that Musk remove dozens of accounts accused of spreading hate speech and misinformation on the platform. Musk’s refusal to comply, coupled with his failure to appoint a legal representative for X in Brazil, led to the drastic action. The court responded by issuing heavy fines, freezing both X and Starlink accounts, and transferring $3.3 million (18.35 million reais) to the Brazilian national treasury as part of the penalties imposed on the tech mogul.
Services Restored, But Fines Still Pending
Although X’s services have now been restored in Brazil, the legal battle is far from over. The company still faces substantial financial penalties. According to reports, X has been ordered to pay over $5 million in pending fines, including a new round of penalties, before it can fully clear its legal hurdles in the country. This ongoing financial burden highlights the broader struggle Musk has faced in navigating legal frameworks in international markets while maintaining his commitment to free speech on his platforms.
