Mathura (Uttar Pradesh): The petition filed in the court of Mathura for the removal of Shahi Idgah, situated in the premises of Shri Krishna’s birthplace, was dismissed on Wednesday. Additional District Judge Chhaya Sharma dismissed the petition filed on behalf of Shri Krishna Virajaman, Shri Krishna Janmabhoomi and his half-dozen devotees.
He said that Lord Krishna is the revered deity of Hinduism, he is known as an incarnation of Lord Vishnu and his innumerable devotees and devotees all over the world and in such a situation, “If similarly every devotee and devotee filed suit If allowed to do so, the judicial and social system will collapse. ” Judge Sharma said that the applicants are neither parties nor trustees of the decree in question. The said decree was given by the court in 1973 in relation to the agreement reached between the Srikrishna Birthplace Trust in 1968 and the Shahi Idgah Management Committee.
The court said that in such a case, it would not be just and reasonable to allow the petitioner to present the suit on the basis of being a devotee, and the submission of suit by the devotee is not permissible even in terms of law. On behalf of the plaintiffs, senior advocate Harishankar Jain and advocate Vishnu Shankar Jain said that they cited sections 16 and 20 of the Indian Penal Code to the court on the question related to the filing of the petition on this issue by outsiders and said that it Every Indian citizen has the right to make a complaint in any district anywhere.
Para 116 of the court’s decision in the matter relating to Ram temple was cited in the court for hearing the case and stated that the concept of temple construction is indelible and beyond the jurisdiction of the court. This concept, taken by Mahamana Madan Mohan Malaviya etc., is maintained even after the construction of the temple. During the hearing, the lawyers of the litigant gave a detailed account of the history related to the construction of Lord Krishna’s birthplace and the grand temple of Lord Krishna in the Katra Keshavdev complex and said that Shri Krishna Janmasthan Seva Sansthan has no right of any kind from the Royal Idgah Management Committee was not. Therefore any agreement entered into by him is illegal. With which his possession of the land occupied for the construction of the royal Idgah is unauthorized. These advocates, in the form of Krishna Sakhi, supported the demand of petitioner Ranjana Agnihotri to hand over the possession of the entire land to Shri Krishna Virajaman.
