Shivraj Cabinet seals draft of ‘Love Jihad’ law in MP, here are 10 special provisions

Bhopal: The Shivraj government has approved the draft Love Jihad law. After discussions with the ministers in today’s meeting, the draft was unanimously sealed by the Cabinet. Now this bill will be introduced in the assembly session starting from December 28. Once passed in the Assembly, the Freedom of Religion Act, 1968 will be considered over. It will be replaced by a new law. A special feature of the draft is that the person who voluntarily converts and the person who converts will have to inform the District Collector 60 days in advance.

Under the Love Jihad Act, no one will be able to force maliciousness, temptation, intimidation, use of force, harassment or other fraud to convert or convert in a complete way. The pressure of the person doing this will be considered a conspiracy.

Responsibility for maintenance is also fixed
The provisions of the new draft also stipulate responsibility for the maintenance of the woman victim of the crime of conversion and the child to be born. Provision has also been made to retain the rights of the child born as heir to the father’s property. Punishment and fine has also been provided against the organization which has converted the religion against the provisions of the Act. Such entities will have the right to revoke the registration of organizations.


The one who converts himself has to do this work

A person who voluntarily converts and a person who converts will have to inform the District Collector 60 days in advance. For not informing the District Collector 60 days before the conversion by a religious person who has converted, a punishment of 3 to 5 years and a fine of Rs. 50,000 has been imposed.


The government amended the provisions of the Act to provide a minimum sentence of 1 year and a maximum of 5 years. Besides, provision has been made to impose a fine of Rs. 25000.
Provision has been made to change the religion of women, minors, Scheduled Castes, Tribes to a minimum of 2 years and a maximum of 10 years and a fine of Rs. 50,000.
Attempts to change religion by concealing religion will result in a minimum sentence of 3 years and a fine of Rs.50,000
There will be a sentence of 5 to 10 years and a fine of up to Rs. One lac.

  • There is a provision of 5 to 10 years imprisonment for violating the law more than once.
  • The government has also included a point in the draft regarding return to ancestral religion. The Act states that in case of conversion, the ancestral religion shall be deemed to be the religion of the father at the time of his birth.
  • In case of conversion, the parents or siblings of the person concerned have to lodge a complaint of action under the Act at the police station.
  • The offenses recorded in the Act are considered non-bailable. The case will be heard by the court.
  • The Act also places an obligation to provide proof of innocence.
  • Contrary to the provisions of the Act, provision has been made in the Act to consider marriage as Nul and Void. The Family Court has also been authorized for this.
