Denial of admit card tantamounts to depriving student of right to education: High Court

Nagpur: Father is working as an employee at CBSE school. And the son is also taking education in the same school. Due to non-payment of salary from the school, the child’s fees could not be deposited, so the school management refused to give the 10th board admission card to the child. As a result, the father had to approach the High Court. Seeing the seriousness of the matter after hearing the petition filed by the father, Justice Rohit Dev, and Justice YG Khobragade ordered the school management to give the admission card to the child immediately. Petitioner’s right Bhumika Sarda, Central Govt. NS Deshpande and Kalyani Deshpande, the assistant public prosecutor of the state government, argued.

Prior information to the school
During the hearing, the lawyer appearing for the petitioner said that the petitioner’s son is a 10th-standard student at the same school where the petitioner is working. The petitioner should have got his salary by now but due to non-payment of salary, he has come under a financial crisis due to which he has not been able to deposit the school fees. He has already given this information to the school management. The school management was also informed that if the admission card is not given, a request will be made to the court for an early hearing of the matter.

Violation of the right to education
The counsel for the petitioner said that an advisory has been issued by the Delhi Commission for the Protection of Child Rights. Similarly, a decision has also been given by the Delhi High Court. According to the Delhi Commission and the Court, refusing to give the admission card is tantamount to depriving the student of the right to education. After the hearing, the court said in the order that the major issues in the petition can be taken up for hearing later, but the examination is going to be held from February 27. In view of this, it is necessary for the student to get the admit card first. Therefore, the court gave strict orders to the school management to give the admission card to the student within 48 hours.
