Washington: In a major relief to thousands of Indian professionals and top American information technology companies, an American court has approved two H-1Bs proposed by the Trump administration. The H-1B visa is a nonimmigrant visa that allows U.S. companies to hire foreign workers for specialized occupations that require theoretical or technical expertise. The United States issues 85,000 H-1B visas each year. These are usually issued for three years and can be renewed. Most of the 6 lakh H-1B visa holders are from India and China.

Northern District of California District Judge Jeffrey White on Tuesday in his 23-page order restrained the Trump administration’s recent policy of requiring employers to pay significantly higher wages to foreign workers on H-1B visas. He also sidestepped another policy that would reduce the eligibility of H-1B visas, which are considered important for US tech companies and other employers.

Following this decision, the Home Department’s rule on employment and other issues, which came into effect on December 7, has now become invalid. The Labor Department’s rule on wages, which came into force on October 8, is also no longer valid. The lawsuit was filed on behalf of some universities, including the US Chambers of Commerce, the Bay Area Council and Stanford, and business bodies representing Silicon Valley’s top companies, such as Google, Facebook and Microsoft.
