New Delhi: The Delhi High Court has sought to know the stand of the Center on a PIL seeking to declare unconstitutional and illegal polygamy by a Muslim husband to practice bigamy or polygamy without the written permission of his wife or wives. has requested. This petition has been filed on behalf of a woman.

A bench of Chief Justice Vipin Sanghi and Justice Navin Chawla issued notice to the Central Government on the petition and directed it to file its reply. The petition sought directions to regulate bigamy or polygamy by Muslim husbands.

It was also said that for this the written permission of the wife should be taken and a certificate should be obtained by the husband from the judicial officer, in which it is verified that he is capable of taking the responsibility of all the wives equally.

Apart from this, before the marriage, he should declare complete information about the previous marriages. The petitioner has also requested to enact a law for compulsory registration of Muslim marriages.

Petitioner Reshma said in the petition that Sharia law states that any Muslim man has to declare that he will keep all his wives equally. In countries where this Sharia law is followed, a Muslim person is allowed to remarry only in extreme circumstances.

The woman told in the petition that she was married to Mohammad Shoaib Khan in 2019. He also has a child. The woman said that her husband had left her thrice saying talaq and now it appears that he is planning a second marriage.
