Gwalior: Following the order of the Madhya Pradesh High Court, a case was registered against Union Minister Narendra Singh Tomar at Gwalior’s Padaw police station on Friday. The Returning Officer of Gwalior East Assembly constituency had applied for registration of FIR.

A case has been registered against Union Minister Narendra Singh Tomar under sections 188, 269 and 51B of the IPC Disaster Management Act. The case was ordered to be registered. In which a case had already been registered against Munna Lal Goyal and the event organizer.

The Madhya Pradesh High Court had shown strictness regarding the violation of Covid-19 in the rallies taking place in the by-elections. The High Court has ordered to register an FIR against former CM Kamal Nath and Union Minister Narendra Singh Tomar for ignoring the rules of Covid-19. At the same time, the court has also issued orders to the collectors of 9 districts to ban election rallies.

What did the Madhya Pradesh High Court say in the order?
A double bench of the Gwalior High Court of Madhya Pradesh based its decision on the rallies of Kamal Nath in Bhander of Datia and Narendra Tomar in Gwalior. In both the rallies, lawyer Ashish Pratap Singh had filed a petition regarding violation of the guideline of Corona-19. The court pronounced its verdict after hearing the matter and also sought a report from the Gwalior and Datia collectors within two days.

Strict court comment
The High Court, while sternly commenting on the election rallies defying the Corona Guideline, said that the Constitution has given rights to both the candidate and the voter. If the candidate has the right to campaign, then the people have the right to live and stay healthy. People have a greater right to be healthy than the right of the candidate. A bench of Justice Sheel Nagu and Justice Rajiv Kumar Srivastava has said in its order that only virtual rallies should be allowed to political parties and if for some reason virtual rallies are not possible then there should be gatherings and rallies in such a situation that Permission has been sought from the Election Commission. The court has directed the Principal Registrar to send a copy of the order to 8 Collectors of Gwalior-Chambal Division and Vidisha Collector.
