In the petition filed by advocate Siddhant Kumar, the petitioners have stated that the then Central Government had wrongly confiscated their property situated on Kasturba Gandhi Marg. He said that the property of his clients’ father was captured by the Ministry of Labor and Employment, Government of India in July 1999 under smuggling and manipulation of foreign exchange. However, later the High Court quashed the property forfeiture action.
The petitioners in the Delhi High Court have said that when the order of detention has been canceled, and the order of confiscation has also been found to be wrong, then the Central Government should be directed to pay the compensation as appropriate. Also, for the period from 1999 to 2020, it should also be directed to pay two crore and twenty lakh rupees as loss of rent and profit from the market price. In his petition, he also asked the central government to pay nine lakh rupees for the loss due to maintenance charges and 43 lakh rupees for the loss due to the property tax.
