The Jabalpur High Court has made it clear that at present, only 14 percent reservation can be given to the OBC category as before. The next hearing of this case will now be held on August 10.

On this, the High Court has ordered the state government that it can prepare the merit list according to the 27 percent OBC reservation, but only 14 percent OBC reservation can be given in the appointment of doctors. The High Court has ordered the state government, including the petitioners, to present their arguments in writing on the matter and has fixed August 10 for the next hearing on the matter.

During the hearing today, it was said on behalf of the state government that it is necessary to increase the OBC reservation in view of the economic-social condition of the OBC class in the state and their large population. On this, it was said on behalf of the petitioners that the Madhya Pradesh government wants to give reservation to the OBC category according to the population, but recently the Supreme Court has declared the Maratha reservation given according to the population in Maharashtra illegal. It was said on behalf of the petitioners that according to the Indira Sawhney Judgment of the Supreme Court, in any case, the reservation cannot exceed 50 percent. At the same time, it was said on behalf of the state government that the Supreme Court itself has made it clear that in special circumstances the reservation can be increased beyond the limit of 50 percent and the large population of the OBC category should be considered as special circumstances in the state. However, while fixing the next hearing on the matter on August 10, the High Court has continued the order to give reservations to the OBC category only 14 percent instead of 27.

Kamal Nath government had increased the reservation
The previous Kamal Nath government had increased the reservation of the OBC category from 14 to 27 percent, which was challenged in the High Court. In the petitions filed against the increased reservation, it has been said that the state government has violated the reservation provisions by increasing the OBC reservation from 14 percent to 27 percent. It has been said in the petitions that the Supreme Court had made it clear in the decision given in the Indira Sawhney case that OBC, ST, and SC categories cannot be given more than 50 percent reservation. But due to the increase of OBC reservation by the state government, the scope of reservation has reached 63 percent.
